The record

Under review

Event venues: the case that is still open.

A permit application for a commercial wedding venue on agricultural land is under City review. This is the one case on this page that has not concluded, and the one where what residents do next still changes the outcome.

A note on how this page is written

This application is live. OASIS argues the policy, not the applicant, so no operator or property owner is named here. Everything below is a determination the City has made or a requirement the City has stated. None of it is characterization.

What the City has determined

  • The application is discretionary, not ministerial. It involves City judgment, so it cannot be approved over the counter.
  • It requires Development Plan review and a noticed Planning Commission hearing.
  • The California Environmental Quality Act applies.
  • The operation as it currently exists appears primarily commercial rather than incidental to agriculture.
  • A connected second parcel must be reviewed together with the first, as one project, rather than separately.
  • No new events should be booked until the required approvals are in place.

There is also an active code enforcement case.

Those determinations matter beyond this application. The question of whether a commercial event business on farmland is agriculture, or is a commercial use that happens to sit on a farm, is the question the entire agricultural corridor turns on. The City has now answered it once, in writing, on a live file.

The part worth knowing

The hearing exists because residents wrote in.

An Administrative Conditional Use Permit is normally processed by staff without a public hearing. That is what administrative means. Most of them are decided without anyone outside the planning counter knowing they happened.

In this case the City planner’s stated reason for recommending a Planning Commission hearing was that the project received public comments.

Comments from residents changed the procedure this application gets. Not the outcome, which is undecided. The procedure. That is the clearest evidence on this entire website that showing up works.

How to be counted on the next one

What is at stake

The gap in Article 14.

Oceanside adopted farm-based agritourism uses in 2018: the lower-intensity activities that bring visitors to a working farm. What the code does not say plainly is whether a commercial event venue is one of them.

That ambiguity is the opening. A site can be partly farmed and primarily used for events, and absent clear language, each application gets argued parcel by parcel, on its own facts, with no accounting of what the corridor looks like after all of them are approved.

Closing that gap is one of the five things OASIS asks the City to do, and it is the only one that would resolve this question before the next application rather than during it.

What it teaches

Comments are not symbolic. In this case they changed what procedure an application gets. The code gap that made the argument necessary is still there.
